Only scenario I'd expect them to entertain eating the cost is if you asked them (and they billed for) going through the axle and rebuilding any part of it (like seals, bearings, r&r locker...) Is this a front diff or rear diff?
Any time I get something used I either accept any failures that happen or I have it rebuilt (particularly wear items like seals & bearings) to prevent any 'assumption breakages'
