Typically when a recall comes out after you had the repair done, they will only compensate repairs if you have a receipt from a dealer or a professional repair shop.

True only if it's a Recall.
But s faulty timing chain won't be categorized as a Recall by NHTSA (National Highway Traffic Safety Administration) since it's not directly affecting the safety.

Oh I know, my post was actually meant to be quite cynical. I seriously doubt anything will come of this for anyone affected.
To me fixed is fixed and MY time has more value than the dealers guy, they should have to pay the going price for the repair. I wouldn’t ask to be reimbursed I’d copy the parts receipts to prove they were bought and then I’d demand reimbursement for labor. They have zero respect for their customers.

I have been compensated for parts only on recalls when I fixed them at home prior to a recall being issued. It helped that it was a OEM part purchased from the dealer. The dealer just verified my repair was correct to clear my VIN from the recall.

I got lucky I think. About 17 years ago, my wife had a Saturn. Had a problem with the head. Coolant couldn’t pass through one part of the head so it was getting hot and warping. I had just bought a new head from the dealership and replaced it myself when I got the letter of recall for certain models in that year. I was told to make copies of my receipts for all the parts. And an estimated labor of my time on the job. Saturn sent me a check for $1700 I was tickled pink.

I have a 06 and had to replace mine because the the tension guides failed actually broke and had pieces of it floating in the engine so this is interesting. It was very expensive to repair.

There's a good chance they reimbursed you for your parts and then charged Nissan for the whole repair under recall. Nissan wouldn't question it if your VIN was showing as open for the recall and Nissan never calls back the parts from recalls. Technically, that would be fraud on the part of the dealer, but it works out well for you!

Well, there are two kinds of recalls. Mandatory recalls are directed by the NHTSA and are safety related. The other recall is a voluntary recall, which is created by the vehicle manufacturer and not mandated by the NHTSA. Those recalls are usually customer satisfaction campaigns and typically have a time limit. Examples would include the 96-97 Pathfinder campaign where they updated a number of parts, replaced tires in some cases and adjusted the load sensing valve to make them similar to the 98 models or the fuel injection campaign on the 84-89 Z cars, V6 200SX and 85-88 Maximas. The idea behind most of those is that they are trying to look good for people who buy their most expensive vehicles in hopes that they will continue to do so.

Dealer did not pay me out for the part, it was Nissan corporate that cut me a check and directed me to the dealership to have it inspected and for the dealer to clear my then Titan's VIN off the recall list. What the dealership claimed for labor is between them and Nissan Corporate. Instruction were on the back end of the Recall instruction on contacting them if I had already paid for the repair. They sent me a form to fill out that that was detailed in delineating if it was parts only or parts plus a dealership shop or independent labor cost. I do not recall if there was anything on claiming compensation for my own labor as I was not sweating that cost nor cared.

I'm glad to hear Nissan took care of you! There are many times when they should do the right thing and unfortunately they don't. Then they wonder why their customer satisfaction ratings aren't too good! I worked for Nissan for 16-years before leaving them in 2003, starting out working on Datsuns and early Nissans when they were a great product until Renault stepped in and changed a lot of things. They can be a really frustrating company. They have the potential to be just as good as Toyota and Honda but they are just too inconsistent. Some of their vehicles are pretty good and some of them are just terrible. Hopefully, they'll get their act together some day!

ive worked at a law firm for the better part of a decade now, i can 100% say this is true for every single class action i have ever seen. they ****ing suck for the client/victim.
At least the offending company is forced to pay, so there is a disincentive for companies to not compensate customers for a poor product.

I got my timing chain fixed at the dealer, but listening to that noise, my initial inability to figure out that noise (until I got that letter), and the expense of fixing it, has driven me to thinking about another brand for my next pickup.

I wonder if there's any word at all on the trial or its outcome. There's no news at falcovnissan.com

Good news if you live in California or Washington, but what about the rest of us? Also notice they do it for 05-07 models of Pathfinders and Frontiers, but the problem existed in 08-10 model years, as well.

Here is a scenario. SO.... I believe my truck (2005 4x4 clubcab) was originally purchased in Vancouver WA, I purchased it out of Portland OR in 2010 with 74K on it, imported it to Canada. Here in Canada i had to replace my timing chain - but apparently it was one of the guides that broke - consistent with this class action. I paid Nissan $1600 to fix. Anyone know if i can get in on the compensation? or know how to find out? I also had to do my fuel Sender.. and now my Cats are going :frown:

I guess the real question is do I have to be living in CA or WA to be included or is it where the truck was purchased? If its former, does anyone know if there are any similar lawsuits for Canadian Residents?

I received the Notice of Proposed Settlement in the mail today. To JRoc's question - the document states that the vehicle had to be purchased or leased in California or Washington.

In a nutshell if the vehicle mileage at the time of repair has:

  • less than 80K - up to $720 or a $1500 voucher for a new car
  • 80K - 100K - up to $450 or $1000 voucher
  • 100K+ - up to $180 or $500 voucher

Yeah, 80% of first $900 paid. I paid $1940.75 at 43,000 miles. That come to 37% of what I paid. I've heard closer to half is typical in cases like this. I'm glad I got something, but overall this experience is still the kind of thing that makes me want to strongly consider Toyota next time.

Got my notice last week for my 2007.How do they reimburse you if you DIY?
No noise as of yet but have only 8k on the truck.
