Class Action Proposed Settlement for Radiator Fluid Leaks

Not sure if this been posted already but...just got one in the mail today. It covers all bought or leased 2005 to 2010 Nissan Pathfinders, Frontiers and Xterras. This settlement resolves a class action lawsuit against Nissan.
Options:
-Submit claim for reimbursement if you paid for repairs.
-If you have not had any problems, your warranty should cover repairs up to 10-years or 100,000 miles.
-Opt out and file your own lawsuit.
There you have it.

class action lawsuits are a joke. the only winners are the lawyers.

I already got notice of the extended warranty and I've had no issues so far. I changed my radiator fluid this fall and had my trans fluid changed this fall as well.

I guess I'm in the Do Nothing category, although I'd bet the primary law firm gets at least $5,000,000 out of the deal.

I wonder if I proactively bought a radiator and ATF from Nissan if they would reimburse me.
Would be an expensive gamble.

Wonder why Nissan waited until a class action law suit was filed, instead of issuing a recall to correct these problems?
Having to resort to a law suit to correct a well known manufacturer defect, leaves a bad taste for Nissan customers.

This is a step in the right direction. Definitely better than nothing, especially for those with an expired warranty.

FWIW, Nissan may replace the radiator for free, but IMO chances are high the transmission has already suffered some damage by the time most people discover the water contamination. Nissan limits their initial fix action to just replacing the radiator and flushing the transmission. For many, the transmission may be operating ok after the flush, but it's a fact water does bad things to a transmission--IMO odds are high the overall longevity of the transmission has been compromised

The repair on my Pathfinder was $6000. A couple of hundred on a radiator is cheap by comparison.
